This Privacy Policy (“Policy”) explains how the Flashvery Operator Team (the “Operator”, “we”) handles personal data and related information of users (creators, buyers, and visitors, collectively “Users”, “you”) in connection with our services (the website and app, collectively the “Service”). We comply with Japanese privacy laws and operate with consideration of applicable laws in the EEA, the UK, Switzerland, California (USA), and other regions.

2. Data We Collect
- Account Data: name or creator name, email, profile, social IDs (e.g., Instagram), country/region
- Transactions & Payments: purchase/sale history, amounts, payouts, billing info (payment card data is processed by payment processors and is not stored by us)
- Content: guides/spots, descriptions, photos/videos, location data, tags, reviews
- Communications: inquiries, surveys, bug reports, beta test notes
- Technical Data: IP address, device/browser, cookie/SDK identifiers, usage & error logs, language/time zone
- Marketing & Measurement: event data from analytics/ads tags (views, conversions, etc.)
3. How We Collect
- Directly from you (input/upload)

- From integrations and public sources (e.g., public social profiles)
- Voluntary feedback/interviews during the Beta
4. Purposes of Use
- Provide the Service; authentication, login, hosting and display of content

- Support and important notices
- Quality improvement & development (analytics, A/B testing, error analysis)
- Prevent fraud/abuse and ensure security (anti-impersonation, anti-redistribution)
- Measure marketing effectiveness; conduct optional beta research

5. Cookies & Similar Technologies
We may use essential, functional, analytics, and advertising cookies/tags. You can disable cookies in your browser; some features may not function properly if you do so.
6. Sharing with / Processing by Third Parties
We share data only as needed for the purposes above and maintain appropriate contracts and oversight with service providers. Typical recipients include:
- Payments: processors such as Stripe (we do not store card data)
- Infrastructure & Delivery: cloud, CDN, email, logging
- Analytics & Ads: analytics providers and ads measurement partners
- AI Features: inputs/outputs/metadata may be processed by AI providers (see §12)
- Legal: disclosures required by law or to protect rights/safety
- Business Transfers: in connection with mergers, corporate splits, or transfers
7. International Transfers
Data may be processed outside your country. Where required, we implement appropriate safeguards (e.g., Standard Contractual Clauses).
8. Legal Bases (EEA/UK)
Contract performance; legitimate interests (service operation, safety, improvement, measurement); consent (e.g., certain cookies/marketing); and legal obligations. You may withdraw consent at any time (without affecting prior processing).
9. Retention
We retain data as long as necessary for the purposes above and then delete or anonymize it. Records subject to statutory retention are kept as required.
10. Security
We apply reasonable security measures (access controls, encryption, audit logs, etc.). However, we cannot guarantee absolute security on the internet.
11. Public Information & UGC
Content you mark as public (profiles, guides, spots, sample works) may be displayed to others. If your uploads include third-party personal data, obtain necessary rights/consents. We may implement technical protections against redistribution or scraping.
12. AI Features
Inputs and related metadata may be sent to AI providers for processing. Where available, we prefer privacy-preserving settings (e.g., model-training opt-out, minimized retention), but provider policies may apply. Please avoid including sensitive personal data.
13. Children
The Service targets users aged 16+. Users under 16 may use it only with parental consent where permitted. If we learn we collected data from a child without proper consent, we will delete it.
14. Your Rights
You may request access, correction, deletion, restriction, objection, and (where applicable) data portability, subject to legal exceptions. EEA/UK users may also contact their supervisory authority. To exercise rights, contact support@flashvery.com; we will verify identity and respond appropriately.
15. Marketing Communications
We send newsletters/updates based on consent or opt-in. You can change preferences at any time via in-message links.
16. Changes to This Policy
We may update this Policy to reflect legal or service changes. Material changes will be announced on the site or via email, and the updated Policy will apply as stated.
